Terms of service

TERMS OF SERVICE (GENERAL TERMS AND CONDITIONS)

Last updated: 12 October 2026

1. SCOPE

1.1 These terms apply to all orders placed through our online shop at https://wearveloura.com (the "Shop") and to all contracts concluded between you and us (see section 2) via the Shop, in the version valid at the time of your order.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 Any terms of the customer that differ from these terms do not apply unless we have expressly agreed to them.

2. CONTRACT PARTNER

Your contract is concluded with:

Veloura
Germany
Email: veloura@ds3-ecom.com

You can find further details in our Contact information (legal notice) at https://wearveloura.com/policies/contact-information.

3. HOW THE CONTRACT IS CONCLUDED

3.1 The presentation of products in our Shop is not a legally binding offer, but an invitation to place an order.

3.2 Ordering works as follows:
- Select a product (and, where available, a variant such as colour) and click the button to add it to your cart (e.g. "Add to cart").
- Open your cart and click the button to go to the checkout (e.g. "Check out").
- At checkout, enter your email address and delivery address, choose a shipping method, add Shipping Protection if you wish, and choose a payment method. Depending on the payment method, you will enter your payment details or log in to the payment provider (e.g. PayPal).
- Before you submit your order, all your details, the products, prices, shipping costs and the total amount are shown again. You can check them and correct any input errors at any time using the input fields, or by going back to your cart.
- By clicking the final order button (e.g. "Pay now"), you place a binding order (offer) for the products in your cart.

3.3 Immediately after you place your order, we send you an email confirming your order (order confirmation). With this order confirmation, we accept your offer and the contract is concluded.

3.4 If, exceptionally, we are unable to deliver an ordered product (e.g. because it is no longer available), we will inform you without undue delay and refund any payments you have already made without undue delay. Your statutory rights remain unaffected.

3.5 The contract language is English.

3.6 We store your order details. You will receive them by email with your order confirmation. If you have a customer account, you can also view your past orders there. You can view and print these terms at any time at https://wearveloura.com/policies/terms-of-service.

4. PRICES AND SHIPPING COSTS

4.1 All prices are stated in euros (EUR) and are final prices including statutory VAT where applicable.

4.2 Shipping costs are €5.00 for orders under €10.00. Shipping is free for orders of €10.00 or more. These rates apply to all destinations. Shipping costs are shown in your cart and at checkout before you place your order. For more details, see our Shipping policy at https://wearveloura.com/policies/shipping-policy.

4.3 You can add optional Shipping Protection for €1.95 (see section 7).

4.4 For deliveries to countries outside the European Union, import duties, taxes and customs fees may be charged by the authorities of the destination country. These charges are not included in our prices and are payable by you, usually to the carrier on delivery. Please check with your local customs office before ordering.

5. PAYMENT

5.1 The payment methods available to you are shown at checkout. Payments are processed by our payment providers, e.g. Shopify Payments and PayPal.

5.2 The purchase price is due immediately when the contract is concluded. Your payment is processed when you place your order.

5.3 Discount codes (e.g. our newsletter welcome code) can only be redeemed at checkout before you place your order. They cannot be exchanged for cash and, unless stated otherwise, cannot be combined with other discount codes.

6. DELIVERY

6.1 We deliver to the countries listed in our Shipping policy, to the delivery address you provide.

6.2 We process your order within 1–2 business days (Monday to Friday, excluding public holidays). Your order is then shipped from our fulfilment partner's warehouse. Your order arrives within 3–8 business days of ordering. As soon as your order has shipped, we send you the tracking number by email.

6.3 If your order contains several items, they may be delivered in separate parcels at no extra cost to you.

6.4 If you are a consumer, the risk of accidental loss of or damage to the goods only passes to you when the goods are handed over to you or to a person you have authorised to receive them. This applies whether or not you have added Shipping Protection.

7. SHIPPING PROTECTION (OPTIONAL)

7.1 At the cart, you can add Shipping Protection to your order for €1.95. Shipping Protection is optional and is only added if you actively choose it.

7.2 If a parcel protected by Shipping Protection is lost, stolen or arrives damaged in transit, we will send you a free replacement or a refund, quickly and without you having to wait for the result of a carrier investigation. To make a claim, simply email us at veloura@ds3-ecom.com with your order number (and a photo if the parcel or item is damaged).

7.3 Shipping Protection does not limit your statutory rights in any way. Even without Shipping Protection, all your statutory rights remain in full. In particular, as a consumer you do not bear the risk of loss or damage in transit before the goods are handed over to you (see section 6.4). Shipping Protection is a convenience service that makes claims as quick and simple as possible.

8. RETENTION OF TITLE

The goods remain our property until full payment has been made.

9. RIGHT OF WITHDRAWAL

Consumers have a statutory right of withdrawal. Full details, including the withdrawal instructions and the model withdrawal form, are in our Returns, withdrawal & refunds policy at https://wearveloura.com/policies/refund-policy.

10. WARRANTY

10.1 The statutory warranty rights (gesetzliche Mängelhaftung) apply. For new goods, warranty claims can be made for 2 years from delivery.

10.2 We only give an additional guarantee if this is expressly stated for a product.

10.3 If goods arrive with obvious transport damage, please report this to the delivery person if possible and contact us as soon as you can. This helps us assert our own claims against the carrier. If you don't do this, it has no effect on your statutory or contractual rights.

10.4 For any warranty issues, please email us at veloura@ds3-ecom.com.

11. LIABILITY

11.1 We are liable without limitation, on whatever legal grounds, for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we have given a guarantee or fraudulently concealed a defect.

11.2 In cases of slight negligence, we are only liable for breaches of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely (cardinal obligations). In this case, our liability is limited to the foreseeable damage typical for this type of contract.

11.3 Otherwise, our liability for slight negligence is excluded.

11.4 These limitations of liability also apply in favour of our legal representatives and vicarious agents.

12. DISPUTE RESOLUTION

The European Commission's online dispute resolution (ODR) platform (https://ec.europa.eu/consumers/odr) was discontinued on 20 July 2025 and is no longer available.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 German Consumer Dispute Resolution Act, VSBG).

If you have a problem with your order, please contact us directly at veloura@ds3-ecom.com. We'll do our best to find a solution.

13. GOVERNING LAW

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law only applies to the extent that it does not deprive you of the protection granted by the mandatory provisions of the law of the country in which you have your habitual residence.

14. SEVERABILITY

If any provision of these terms is or becomes invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory provisions.
